23.01.01.01. 01 Who May File.. Any interested person may file a petition with the Board of Public Works (the "Board" with respect to the applicability of any statute pertaining to the Board or the applicability of any regulation adopted by the Board.

23.01.01.02. 02 Form.. The petition shall be in writing and shall contain a detailed statement of the facts. It shall question the applicability of the State statute or regulation to these facts. The petition shall contain the name, address, and telephone number of the petitioner and a statement describing the petitioner's interest in making the request for the declaratory ruling. 23.01.01.03. 03 Submission, Consideration, and Disposition.. The petition shall be filed with the Secretary to the Board for the Board's consideration and disposition. The Board shall consider the petition and may, in its discretion, issue the declaratory ruling requested.
