14.07.03.01.htm 14.07.03.01. 01 Scope.. These procedures shall govern the hearings which the Maryland Automobile Insurance Fund is required to provide to a producer when the Fund may refuse or has refused to accept further applications from the producer, or when the Fund may terminate or has terminated the producer's authority to bind coverage in the Fund, or both. These procedures do not apply to conferences or other informal investigations or proceedings at which no formal disciplinary ruling is to be made.

14.07.03.03.htm 14.07.03.03. 03 Notice of Disciplinary Action and Hearing.. A. In cases involving potential producer disciplinary action, which may be taken after a hearing with the Director of Fiscal Operations, Director of Underwriting or the Director's designee, the Director or the designee shall provide the producer with written notice of the following:1) Date, time, place, and nature of the hearing;. 2) Legal authority for the action;. 3) Proposed action or remedy, if any; and. 4) A short and simple sta
14.07.03.04.htm 14.07.03.04. 04 Conduct of Hearings.. A. Hearings under Regulation .03A of this chapter shall be conducted by the Director of Fiscal Operations, Director of Underwriting or the Director's designee.B. Hearings under Regulation .03B(4) of this chapter shall be heard by a member of the board of trustees of the Fund designated by the chairman of the board. 14.07.03.05.htm 14.07.03.05. 05 Record of Hearing.. A. The presiding board member shall prepare and maintain an official record, which shall include all pleadings, testimony, exhibits, proposed findings of fact and conclusions of law, and all other memoranda or documents filed in the proceeding.B. A record of the proceedings may be made at the request of the presiding board member or any party. This record may be transcribed only at the request of the presiding officer or a party. All costs
14.07.03.06.htm 14.07.03.06. 06 Decision and Order.. A. At the conclusion of the hearing, or as soon afterward as may be practical, the presiding board member shall issue a Decision and Order, including findings of fact and conclusions of law, which shall be served upon the parties or their counsel, if represented. The presiding board member may also require the parties to submit proposed findings of fact and conclusions of law.B. The Decision and Order is the final administrative decision of the Fund.
