14.07.01.01.htm 14.07.01.01. 01 Definitions.. A. In this chapter, the following terms have the meanings indicated.. B. Terms Defined.. 1) "Board" means the Maryland Automobile Insurance Fund Board of Trustees as described in Insurance Article, §20-202, Annotated Code of Maryland.2) "Boardroom" means the executive conference room located in the facility, or the meeting room used for a Board of Trustees meeting in open session.3) "Executive Director" means the administrative head of the Maryland Autom
14.07.01.01-1.htm 14.07.01.01-1. 01-1 Principal Office.. The principal office of the Board shall be the home office of the Maryland Automobile Insurance Fund, presently located at 1750 Forest Drive, Annapolis, Maryland 21401.
14.07.01.02.htm 14.07.01.02. 02 Membership of Board of Trustees.. The Board shall consist of 13 persons, who shall be appointed in accordance with, and whose term of office shall be as specified in Insurance Article, §20-202, Annotated Code of Maryland.
14.07.01.03.htm 14.07.01.03. 03 Powers and Duties of Board of Trustees.. The Board shall exercise the powers and perform the duties conferred upon it by statute, or by other applicable law or regulation.
14.07.01.04.htm 14.07.01.04. 04 Time and Place of Meeting.. The Board shall meet periodically, as necessary, at specific times determined by the members. The place of the meetings shall be the principal office of the Board, unless another location for a particular meeting is decided upon by the members. The meetings shall be held in conformity with the provisions of State Government Article, Title 10, Subtitle 5, Annotated Code of Maryland.
14.07.01.05.htm 14.07.01.05. 05 Attendance at Meetings.. A member of the Board may not designate another person to appear in his stead, or as his representative or proxy.
14.07.01.06.htm 14.07.01.06. 06 Presiding Officer.. The Chairman of the Board shall act as Chairman of the meetings of its members. In the absence of the Chairman, a temporary chairman chosen by the members shall preside. The Chairman shall serve a term of 1 year following election to office by a majority of the Board. A member may not be elected Chairman more than 2 terms in succession. The office of Chairman shall be filled alternately by an industry member and by a public member.
14.07.01.07.htm 14.07.01.07. 07 Secretary.. The Chairman of the Board, with the advice and approval of the members, shall designate a person to be Secretary, who shall keep the minutes of its meetings and shall perform such other duties as are required of him by the Board. The person chosen as Secretary need not be a member of the Board.
14.07.01.08.htm 14.07.01.08. 08 Notice of Meetings.. A written notice, signed by the Chairman, or in his absence by the Secretary, shall state the exact time and place of each meeting, and shall be mailed to each member of the Board not less than 10 days before the meeting.
14.07.01.09.htm 14.07.01.09. 09 Quorum.. A quorum at any meeting of the Board is seven members, provided that at all times there shall be at least three industry members and at least three public members present.
14.07.01.10.htm 14.07.01.10. 10 Voting.. Except as otherwise provided in these bylaws, action of the Board may be taken upon a majority vote of the members present. Each member shall be entitled to cast one vote.
14.07.01.11.htm 14.07.01.11. 11 Minutes.. The Secretary shall take the minutes of each meeting of the Board. A copy of the minutes of the last meeting shall be mailed by the Secretary to each member of the Board in advance of the next scheduled meeting, and consideration of the minutes shall be included as an item on the agenda of that meeting. The minutes of each past meeting shall be reviewed by the members of the Board, revised as necessary, and then adopted as the official record of its proceedings.
14.07.01.12.htm 14.07.01.12. 12 Action by the Board.. Any action required to be taken by the Board shall be taken at its regularly scheduled meetings, except that in circumstances when immediate action is necessary and there is insufficient time to call a regular meeting, the Chairman may contact the members of the Board, individually, and apprise each of them of the matter demanding their consideration, and obtain their separate decisions or votes, or both, upon it. 14.07.01.13.htm 14.07.01.13. 13 Executive Session.. The Board may decide to conduct certain proceedings in executive session when permitted under the terms of the Governor's Executive Order dated May 25, 1976, as amended, or by other applicable law or regulation. An executive session of the Board shall be closed to the public. Separate minutes of an executive session of the Board shall be maintained by the Secretary, and these minutes shall be privileged from public disclosure.
14.07.01.14.htm 14.07.01.14. 14 Committees.. The Chairman of the Board, with the advice and approval of the members, is authorized to appoint one or more committees to study subjects relating to the management and operations of the Maryland Automobile Insurance Fund, which committees shall report and make recommendations to the Board. The persons appointed to the committees need not be members of the Board.
14.07.01.15.htm 14.07.01.15. 15 Conduct of Meetings.. The meetings of the Board shall be conducted in accordance with Robert's Rules of Order, except as otherwise expressly provided in these regulations.
14.07.01.16.htm 14.07.01.16. 16 Public Participation at Meetings.. A. At any open session of the Board, the general public is invited to listen and observe.. B. Members of the public attending an open session may not participate in the session unless public testimony, questions, comments, or other forms of public participation are expressly invited by the Board.C. An individual attending an open session of the Board may not engage in any conduct that disrupts the session or interferes with the opportunity of

General Provisions.. 1) Extended coverage of proceedings is permitted unless prohibited or limited in accordance with this chapter.2) Extended coverage of the facility outside the boardroom is prohibited.. 3) Nothing in this regulation is intended to restrict the present rights of the media to report proceedings.B. Request for Extended Coverage.. 1) Requests for extended coverage shall:. a) Be made in writing to the Executive Director;.
14.07.01.18.htm 14.07.01.18. 18 Amendment of Regulations.. These regulations may be amended by the vote of eight members of the Board at any duly called meeting, provided a copy of the proposed amendment of the regulations is mailed to each member in advance of the meeting and notice of the action to be taken is contained in the notice of the meeting.
