10.13.05.01.htm 10.13.05.01. 01 Scope.. A. These regulations enumerate the responsibilities of the Department of Health and Mental Hygiene, its local health departments, contractors, and persons sentenced by the Judiciary to attend the Substance Abuse and Sexual Offender AIDS Education Program.B. These regulations do not enumerate responsibilities of the Judiciary or the Department of Public Safety and Correctional Services in relation to the Substance Abuse and Sexual Offender AIDS Education Program.
10.13.05.02.htm 10.13.05.02. 02 Definitions.. A. In this chapter, the following terms have the meanings indicated.. B. Terms Defined.. 1) "Contractor" means either:. a) A local health department which is conducting SASOE educational sessions; or. b) An agency which contracts with a local health department to conduct SASOE educational sessions.. 2) "Department" means the Department of Health and Mental Hygiene.. 3) "Division of Parole and Probation" means the organizational unit within the Department of Public
10.13.05.03.htm 10.13.05.03. 03 Responsibilities of the Department.. The Department shall:. A. Provide a curriculum for the SASOE Program which includes all of the following elements:. 1) Information about HIV, AIDS, and HIV transmission;. 2) Information about measures available to prevent the spread of HIV, including all of the following:a) Preventing transmission related to alcohol or drug use; and. b) Using condoms when having sex;. 3) An assessment of an individual's risk of becoming infected with HIV;.
10.13.05.04.htm 10.13.05.04. 04 Responsibilities of the Local Health Department.. The local health department shall:. A. Deposit all fees received from contractors or individuals attending an SASOE educational session into a separate account;B. Provide training to the employees of the contractors who are conducting the SASOE educational sessions;C. Monitor all SASOE program activities conducted by contractors employed by the local health department to conduct SASOE program activities; and

The contractor shall:. 1) Conduct SASOE educational sessions which meet all of the following criteria:. a) Each session is at least 4 hours in length,. b) Each session includes all of the elements of the curriculum described in Regulation .03A of this chapter, andc) Not more than 25 individuals are scheduled to attend each session;. 2) Accept as a student each individual sentenced by a judge in Maryland to attend an SASOE education
10.13.05.06.htm 10.13.05.06. 06 Responsibilities of an Individual Attending an SASOE Educational Session.. An individual attending an SASOE educational session shall:. A. Pay a fee of $20 before the session begins;. B. Show proper identification to verify that the individual sentenced to attend the session is the same individual who is present for the session; andC. Refrain from disruptive behavior during the session..
